Bail was to last all through appeal process as per Judge
Houston, however Melanie Pierson (FDA) threatened to tie up Bail in a higher
Court, thus Jim would have not been out at all for up to two years more than
likely.
Jim is in high spirits,
and has already made friends in his new home.

Although Jim is very humble, thankful and at piece with his circumstances, the
FDA has completely ruined him financially, if you could even spare a little it
would go a long way.

Feb 8th 2010 8:30PM More info just arrived. After much
deliberation over relevancy of Sentencing Guidelines, they were deemed not
useable.
The well worn issue of Victims got put down as the
Judge Houston stated how many of the letters he has received mentioned actual
benefits and no vulnerable Victims as such, no stealing. He also said "Jim was
providing product they wanted.”
Judge Houston felt FDA has not kept pace with
alternative medicine and that the FDA needs to catch up.
Melanie did a big speech of how important it was to
deter others out there that are selling these Devices.
The final outcome is around 40 months starting April
2nd . Jim's time served will be factored in to his sentence. There also is a
$250,000 fine and 3 yr probation.
Jim & Sata would very much like to thank everyone for
your calls and e-mails from around the World, with prayers and concerns, an
appeal will be filed within Ten days. Check back for more information as it
becomes available.

1st 2010 On Monday at 8:30 AM PST Jim Folsom is on the docket to be
sentenced. Jim is in good spirits, and his health has improved somewhat
being back at home with his lovely wife Sata, on bail for some 45 days.
Supporters of Jim are asked to pack the courtroom (and the street!!) on the day
of sentencing. Everything will now rest on Appeal, as Jim's original attorneys
evidently did not apply for a miss trial within the required time limits.

Jim's supporters are asked to arrive about 45 minutes early and someone will be
there to brief you with what's going on. Jims supporters are asked to Sit on the
defendants side so the Judge knows you are there to support Jim.

July 17th in an approximate 20 minute sidebar, Jim has
been give 30 days by the judge to come up with new attorneys, media was
present, as well as approximately 20 friends and family.

Jim is most appreciative of all the support, e-mail,
letters, and phone calls coming in from around the World.

The judge has scheduled a hearing for Friday, July 17th at
11:30AM to consider the motion that has been filed for Jim to represent
himself.
No one on the volunteer group helping Jim has any idea how long
this might take. We just found it kind of odd that it’s scheduled for 11:30AM
which generally is around the lunch hour so are thinking it may be short.
The group thinks this will be open to the public, and the
suggestion is it would be good for the judge to know that there are many eyes
on this case and important to do what is right for Jim and the U.S. A few of
Jim’s close friends, relatives, and neighbors are planning on attending. If
you live in or close San Diego and it wouldn’t be too much trouble to attend,
or you’re strongly motivated to help out in any way you can, please do
attend.
